A Buffalo man was arraigned on Thursday facing charges of rape after allegedly raping an intoxicated victim who was unable to give consent, according to the Erie County District Attorney's Office. Joseph M. Folvarcik, 47, is accused of sexually assaulting the victim while working as an independent taxi driver, transporting them from an Orchard Park bar to his residence in Buffalo.

Officials state that Folvarcik engaged in sexual intercourse with the victim without their consent. The victim, who was physically helpless due to intoxication, was unable to provide consent. It is important to note that Folvarcik was not known to the victim prior to the incident.

Folvarcik has been charged with first-degree rape and sexual misconduct. If convicted, he could face a maximum sentence of 25 years in prison. He was released on bail, which was set at $75,000.
