Suspect Violates Order of Protection and Hides in Denny’s Bathroom to Avoid Arrest

 

Niagara Falls Police responded to the 9300 block of Cayuga Drive around 4:30pm on November 5th after reports of an order of protection violation.


Upon arrival, officers spoke to the complainant who stated that he was outside walking to his neighbor’s house directly next to him when a male neighbor from across the street whom he has an order of protection against rode by on a bicycl. The man shouted, “I will beat your fuc*ing ass. I only have six days left in this house I will fuc*ing kill you.”



Niagara Falls Police confirmed the order of protection and then attempted to make contact with the male at his residence. After knocking on the door, the male told officers that he was going to “fuc* [them]” and that he was “bisexual.” They declined his invitation and left as the male would not come out of his home.


Later in the evening around 9pm while patrolling the area of Denny’s on Niagara Falls Boulevard, officers observed the suspect from earlier in the day walking eastbound. After police saw him, the male ran into Denny’s and hid in the male’s restroom.



Officers waited outside the restaurant for him to exit. Once he exited, the male spoke to officers in the same vulgar way as earlier in the day. He was placed under arrest and, while in the process of being put into the patrol vehicle, spit in an officer’s face.


At this time officers used force to get him into the vehicle. The specifics were not disclosed in the official police incident report.



He was transported to police headquarters for booking, processing and then placed in a jail cell pending arraignment. No further information is available at this time.
