In a court hearing held on Monday at Niagara County Court, 34-year-old Kyle Elder made the decision to waive his right to a full extradition hearing. Elder has agreed to be transported to the state of Kansas to face a criminal charge against him. The charge stems from his alleged solicitation of a 14-year-old girl who he met and groomed on the internet.
According to court records, Elder is facing a single criminal count of solicitation for his online communication with the underage girl who resides in Kansas. The court proceedings further revealed that Elder, a registered level 3 sex offender, had previously committed sex crimes in 2012 in North Tonawanda.
Law enforcement authorities took Elder into custody on Friday, August 23rd, during the execution of a search warrant at his residence on 17th Street in the City of Niagara Falls. Arresting officers included those from the Niagara Falls Police Department, Kansas Police Department, the Niagara County Sheriff's Office and the New York State Parole officers.
Elder, who had been serving a 10-year prison sentence for his previous conviction, was released on 10-years post-release supervision. However, his recent arrest has raised questions as to whether he will also face a parole violation and law enforcement officials anticipate that he will face additional charges for that.
