A preliminary report from the Hillsborough County Medical Examiner revealed that his sepsis originated from a dental infection and retained tooth roots. Cardiovascular disease was also listed as a contributing factor to his death. However, a full autopsy, which will include toxicology among other information, is yet to be released. This is the first instance that a death in Hillsborough County has been attributed to this specific type of dental sepsis. Williams had a successful football career, playing for Tampa Bay Buccaneers for four seasons from 2010, after he was drafted from Syracuse. His best performance was in his rookie year when he achieved 11 touchdowns and received 964 yards. Williams also had stints with the Buffalo Bills and Kansas City Chiefs before his NFL exit in 2016. Emergency teams from the Upper Mountain Volunteer Fire Company and Town of Niagara Police Department attended the scene. An ongoing investigation is currently being carried out.

New York Attorney General Letitia James today sued SiriusXM Radio, Inc. (SiriusXM) for trapping consumers in subscriptions and maintaining deliberately long and burdensome cancellation processes. An investigation by the Office of the Attorney General (OAG) found that SiriusXM forces its subscribers to call or chat online with an agent to cancel a subscription, then deliberately draws out those interactions as part of its strategy to prevent subscribers from canceling. The OAG also found that the company trains its agents to not take “no” for an answer when customers try to cancel, making it extremely difficult and frustrating for consumers to end their subscriptions. Through this lawsuit, Attorney General James seeks restitution, penalties, and disgorgement from SiriusXM for violating New York’s business laws. “Having to endure a lengthy and frustrating process to cancel a subscription is a stressful burden no one looks forward to, and when companies make it hard to cancel subscriptions, it’s illegal,” said Attorney General James. “Consumers should be able to cancel a subscription they no longer use or need without any issues, and companies have a legal duty to make their cancellation process easy. New Yorkers can trust that when companies like SiriusXM try to take advantage of them and violate the law, my office will step in to stop them.” SiriusXM is an audio entertainment company headquartered in New York City and has approximately 35 million subscribers, of which nearly 2 million are New Yorkers. The OAG opened an investigation into the company after hundreds of consumers reported to OAG and other agencies that they could not cancel their subscription. The OAG’s investigation found that the company trains its agents to keep customers on the phone or in the chat for a lengthy six-part conversation that includes asking a series of questions and then pitching the subscriber as many as five retention offers, all to delay cancellation. When customers decline the offers, agents are trained not to take “no” for an answer and to keep bombarding customers with questions or offers until they either relent or become frustrated. According to SiriusXM’s own data, it takes subscribers an average of 11.5 minutes to cancel by phone, and 30 minutes to cancel online, although for many subscribers it takes far longer. Subscribers often spend substantial time waiting to be connected with an agent, with wait times that regularly reach more than 20 minutes for online chat agents. Despite these long wait times, OAG found that the company can cancel a customer's subscription with a simple click of a button, or even allow customers to do so themselves. In affidavits submitted to OAG, consumers described how difficult it was to cancel subscriptions they no longer used or wished to pay for. In one case, a SiriusXM agent kept a subscriber in a chat for 40 minutes, despite the subscriber’s clear and repeated requests to cancel, according to a log of the chat. And after that, the company continued to charge the customer anyway. When the consumer then filed a complaint, SiriusXM said that it was not able to locate any cancellation request from him. Another complaint — handwritten by a consumer on behalf of her 92-year-old mother — described a maddening phone call with a SiriusXM agent that lasted nearly 40 minutes. The OAG’s lawsuit charges that SiriusXM violated state and federal laws concerning subscriptions that renew automatically by failing to provide subscribers with a cancellation mechanism that is simple, timely, and easy to use. The OAG’s lawsuit also alleges that SiriusXM engaged in fraud and deception by misleading subscribers seeking to cancel. Through her lawsuit, Attorney General James seeks full restitution for all impacted subscribers nationwide, including compensation for the time SiriusXM wasted by putting its subscribers through a deliberately lengthy cancellation process. Attorney General James also seeks disgorgement, penalties, and costs, and to require SiriusXM to implement a simple and easy-to-use cancellation process. Attorney General James asks any consumers who have been affected by SiriusXM’s cancellation practices, or the deceptive or fraudulent cancellation practices of any other automatic-renewal service, to file a consumer complaint online. This matter is being handled by Assistant Attorney General Adam J. Riff of the Consumer Frauds & Protection Bureau, under the supervision of Bureau Chief Jane M. Azia and Deputy Bureau Chief Laura J. Levine. The Consumer Frauds & Protection Bureau is a part of the Division of Economic Justice, which is led by Chief Deputy Attorney General Chris D’Angelo and overseen by First Deputy Attorney General Jennifer Levy.

On Monday, December 18th, New York State Senate Minority Leader Rob Ortt had the honor to meet Senate Veteran Hall of Fame inductee, Herbert Loesch, of Barker, and present him with his official recognition of becoming a member of the New York State Senate Veteran’s Hall of Fame. “Herbert Loesch was chosen for this prestigious honor because he exemplifies what it means to be a patriotic American and proud military veteran,” said Senator Ortt. “Mr. Loesch not only proudly served his country during the Korean War, but he has spent a lifetime preserving and showcasing our great military history – it is my sincere hope that Mr. Loesch’s efforts have and will continue to inspire many others to appreciate and respect our military and its many service members.” A decorated Army veteran, Mr. Loesch’s military career began in 1952 when he enlisted in the US Army, following his education at Alfred State where he majored in biology and minored in chemistry, receiving a BA degree. After basic training at Camp Pickett in Virginia, Mr. Loesch would receive advanced medical training at Fort Devens in Massachusetts. After his training, he was deployed to Korea where he served as a Medic with the 24th Division, obtaining the rank of Sergeant First Class. His accolades include the Korean Service Medal, Presidential Unit Citation (ROKDA), United Nations Service Medal, and the National DEF Service Medal. In 1954, Mr. Loesch was honorably discharged from the Army and became actively involved in the Barker Chapter of the American Legion Post #425 as well as a member of the Veterans of Foreign Wars. Mr. Loesch collects, maintains, and proudly displays Military Memorabilia at his home, including a collection of more than 1,000 toy jeeps. He keeps a prominent Military Display of World War II and Korean War at the Barker High School, utilizing these collections to discuss our nation’s military history and encourage young people to pursue careers in the armed forces. During local parades, Mr. Loesch can be found in the lineup with his restored World War II Willys Jeep, wearing his full military uniform. Mr. Loesch remains an active member in his community as well, serving as treasurer in his church, treasurer to the Western New York John Deere club, a member of the Masonic Lodge #639 and volunteers to place flags at military gravesites. Mr. Loesch currently lives in Barker with longtime partner, Grace. His two children also reside in New York.

New York State will form a committee focused on contemplating possible reparations for addressing the continuing, damaging effects of slavery in the region, according to legislation recently signed by Governor Kathy Hochul. This measure coincides with various attempts across American cities and states to determine suitable ways of grappling with the nation’s oppressive history. It aligns with the establishment of comparable task forces in states like Illinois and California. At the signing ceremony of the bill in New York City, Governor Hochul, a member of the Democratic Party, commented, "We in New York pride ourselves in taking the moral high ground on the issue of slavery, which we typically attribute to the Confederacy and the Southern states. However, it is crucial to recognize that our own state prospered from the institution of slavery. It is an unsightly aspect of our history, yet it is indisputably true." The new legislation, passed by state lawmakers back in June, mandates a comprehensive study by the commission into the level of federal and state government backing of slavery. The committee will additionally explore how New York State, which ended slavery entirely by 1827, participated in the transportation of enslaved Africans and investigate the continuous impact of slavery on today's Black New Yorkers. A team of nine will constitute the commission, required to present a report a year post their first meeting. Although they could suggest financial restitution, such recommendations would not be obligatory. The purpose of these findings is to prompt alterations in policies and trigger initiatives and programs that aim to counteract the negative impacts of slavery on the Black community in New York.

Niagara County Legislature Chairman Becky Wydysh today announced the new Niagara County ambulance service answered its first call this past Sunday and is now fully operational to serve the residents of Niagara County.  The county has two ambulances in service. “Over the last several years, we have faced the dual problems of a declining number of volunteer firefighters coupled with more regulatory demands on those same volunteers,” said Wydysh.  “This is a problem across the state and the result leads to longer response times for citizens who need help.  The county had to establish an ambulance service to supplement our volunteers.” Wydysh thanked the county’s volunteer fire companies for their patience as the county was taking the necessary steps to put the new ambulance service in place. Jonathan Schultz, Niagara County Director of Emergency Services, said the new service is comprised of two crews and a supervisor with a service that covers from 5 a.m. to 5 p.m. for one crew and 6 a.m. to 6 p.m. for the second crew every day of the week. “We extensively reviewed our data on EMS calls and it came as no surprise that the toughest challenge for our volunteer companies is to respond to calls during the workday,” said Schultz.  “So we worked closely with our Fire Advisory Board and our fire chiefs to devise a schedule to fill in those gaps.  I want to stress we view the county ambulance services as supplemental to the great work already being done by our volunteers.” Schultz said over the last month, the county has hired six EMTs, four paramedics, two supervisors and a division manager for the ambulance service. "Our new team was excited to finally begin serving the people of Niagara County and we have already answered more than a dozen calls,” said Schultz.

This shocking account encapsulates a thrilling, horrifying, and regrettable blend of sheer bravery and fatal negligence. Born in Camarillo, California, Robert Overacker was a passionate and skilled jet ski stunt performer. Yet he wasn't the stereotypical daredevil. The 39-year-old held a commendable goal of bringing attention to the nationwide plight of homelessness. He decided to do something bold and extreme - he planned to plunge over Niagara Falls on a jet ski to draw attention to his cause. On October 1, 1995, the stuntman put his plan into action, becoming the seventh person in the modern era to intentionally go over the Horseshoe Falls, the largest of the three falls that make up the Niagara Falls. To capture the monumental moment, his brother and a friend positioned themselves on the banks, cameras ready. Overacker, garbed in a bright red suit, yellow lifejacket and helmet, embarked on his ride of no return atop a green Sea-Doo jet ski. Thousands of spectators watched in suspense and horror as Overacker propelled towards the 180 foot plunge. He designed his jet ski with a rocket-propelled parachute to provide him a safe landing after the free-fall. He passed the point of no return, accelerated, and launched off the falls into the tempestuous mist. However, as he hurtled down, disaster struck. Overacker’s rocket-propelled parachute, which was supposed to eject and provide a safety net, malfunctioned and failed to deploy correctly. Onlookers watched in dread as he plummeted towards the raging water without anything to break his fall. The plunge was lethal. The sheer impact against the tumultuous churn of Niagara’s basin shattered his body, killing him almost instantly. His brother and friend on the bank were left in shock, their joyous anticipation turned to morose horror. Overacker's lifeless body was quickly recovered by the Maid of the Mist tour boat, just minutes after his fatal descent. Overacker’s grim endeavor etched his name in the annals of Niagara Falls as the fifteenth person known to go over the falls, and only the fifth who didn’t survive.
