Niagara Falls Police were on routine patrol and performing a traffic stop on July 31st around 9pm when one of the officers observed a female, male and young child screaming across the street. The male was overheard shouting at the female, “the only way to get him to stop is to let him cry.”
Officers watched as the male began to walk down the street with the child. He then began to “physically and aggressively shake the child” on three separate occasions that officers witnessed.
The male would shake the child for 20-30 seconds. Each time, the child’s head would be violently moving back and forth, arms flailing and would become more upset each time that it happened. The male was also mocking the child each time he cried, pretending to cry louder and louder in a sarcastic, sadistic manner.
Officers yelled to the male to stop but he did not listen. He kept walking with the child. They relocated to where the male was with the child at which point the female was running toward them shouting “that’s my child.”
Both officers were attempting to get the male’s attention to have him let go of the child but he was zoned out staring at him in a rage. Police attempted to detain the male when he began to tense up and flail his arms. He refused commands to put his hands behind his back, but was eventually secured in handcuffs. At this point, he was placed under arrest and put in the rear of a patrol vehicle.
While speaking to the female, she began to scream at officers. “You arrested my boyfriend,” she shouted. Alarmingly, she was not concerned whatsoever that her child had just been violently shaken by her boyfriend. In fact, she watched.
The female continued to argue with officers and refused to give them her name. Officers relocated to their residence where an empty bottle of tequila was sitting on the porch. The female’s mother was present and police described to her what had occurred. The mother told her daughter to stop swearing several times and to get inside the house due to her aggressive behavior.
While transporting the male to police headquarters for booking and processing, he spit on an officer. Once he was placed in the holding tank, the male peed the floor and began to throw up. He was unable to be fingerprinted and photographed due to being uncooperative.
