Niagara Falls Police were on routine patrol on 19th Street passing Forest Avenue when officers observed a male known to law enforcement riding a bicycle. While driving past him, officers saw what appeared to be a clearly visible black handgun in his waistband.
“19th Street is a high crime area in the City of Niagara Falls with a lot of violence involving guns and narcotics,” wrote the responding officer in their police incident report.
Once the male saw police he put his shirt over said firearm and tried to pick up speed. Officers requested backup and followed the male until a second patrol vehicle arrived. Both vehicles activated their lights and advised the male to stop and show them his hands. The male refused to comply and fled from officers.
Officers were ultimately able to apprehend the male near LaSalle Avenue. One officer acquired a target on the male with her department issued firearm advising him to show his hands. Officers did take the male into custody without incident. Officers observed what appeared to be a black handgun on the ground a few feet in front of the male. The male stated, “it’s just a BB gun.”
Upon further investigation, it was determined that the male was in possession of a black glock replica gun. “Throughout my experience as a police officer it is common for individuals to use imitation pistols to commit felonies,” wrote the responding officer.
Law enforcement noted in their report that all of the factors and circumstances of observing the male’s behavior, mannerisms, movements, and proximity to gun-related and high crime areas "to support unlawful use of a firearm."
While searching the male to transport him to police headquarters, officers emptied his pockets and observed suspected narcotics. He was transported to police headquarters for booking and processing.
