A Niagara Falls man has been charged with illegally selling firearms, including a machine gun, to a police informant over an eight-week period this summer. Dayzon McCarthy, 21, faces charges of trafficking in firearms and illegal transfer of a machine gun, according to federal court records filed by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
The ATF Task Force officers, while conducting a covert operation, observed McCarthy selling handguns, including a ghost gun with a machine gun conversion switch that allowed it to function as a fully automatic weapon. The transactions took place on June 20th, June 28th, July 3rd, and August 12th in Niagara Falls.
The police informant, under the watchful eyes of the ATF Task Force, made the purchases. According to an affidavit signed by ATF Task Force Officer Jonathan Andres, McCarthy has a prior conviction for second-degree criminal possession of a weapon, a felony, in Niagara County Court in 2021. He served a two-year prison sentence for the offense.
In a related case, another Niagara Falls man, Dustin McCarthy, 43, was also charged by the ATF Task Force with trafficking in firearms. Dustin McCarthy allegedly sold a 9mm pistol to a police informant for $700 on July 23, 2024, while being monitored by ATF Task Force officers. He has previous felony drug charges in Niagara County Court and is currently facing federal drug trafficking charges, as stated in the affidavit signed by Officer Jonathan Andres.
