'I was crying' says Drunk Driver to Niagara Falls Police

Niagara Falls Police responded to the 1500 block of 13th Street for a crash involving two vehicles that occurred around 11:15pm on March 31st.

Upon arrival, officers met the male driver of the striking vehicle who confirmed he was driving and crashed into another vehicle. The driver stated that he was the only person in the vehicle.

While speaking with the driver, officers detected a heavy odor of alcoholic beverage emanating from his breath as he spoke. The driver also had glassy eyes, which upon being pointed out to him he said it was because he “was crying.” The driver was then moved to the sidewalk for standardized field sobriety tests.

On the sidewalk, the driver failed the horizonal gaze test. On multiple occasions, the driver was unable to follow the stimulus pen and kept moving his head while attempting to follow. He was also observed staring blankly into the distance instead of paying attention to the test.

During the walk and turn test, he began too soon and couldn’t keep his balance. During the walking phase, he had to grab and hold onto a nearby fence and tree to help keep his balance and not fall.

While undergoing the testing, he told officers that he had “one beer and that’s it.” The driver could not complete the one leg stand without losing his balance.

After completing the testing, which he failed, the officer administered a breathalyzer. The driver submitted a sample of .14% BAC.

At this point, the suspect was placed into police custody. Officers read his Miranda Warnings at 9:04pm and he was transported to police headquarters for booking and processing.
