DWI Arrest: “I Have No License, I’m Drinking and Driving...Do What You Do Bro"

Niagara Falls Police were on routine patrol when they observed a vehicle traveling on the 1400 block of Hyde Park Boulevard with its front passenger side headlight inactive. Officers turned around and activated their lights to initiate a traffic stop.

Officers spoke with the male driver and sole occupant of the vehicle about his inactive headlight. While speaking with the male driver, police immediately observed him to have glassy eyes, slurred speech, and a heavy odor of alcoholic beverage emanating from his breath as he spoke.

The officer observed an opened container of alcohol, later identified as a 25 oz can of Hurricane, in the front center console cup holder. Within seconds of conversing with him, he did state, “I have no license, I’m drinking and driving . . . do what you do bro.”

At this point, officers had the male exit the vehicle and begin a field sobriety test, at which point the male said again, “I’m telling you I’m drinking and driving.”

Officers then administered a preliminary breath test that came back with a BAC above the legal limit. The male was taken into custody and transported back to police headquarters for booking and processing.
