Niagara Falls Police responded to the Seneca One Stop around 1:30pm on July 28th after reports of an accident involving property damage.
Upon arrival, officers observed a white 2020 Malibu that crashed into the gas station pump barrier with a cracked windshield and airbags deployed. The driver of the vehicle was incoherent and unable to answer basic questions.
The male could barely stand up on his own after exiting the vehicle. Officers immediately smelled alcohol coming from his person and the vehicle. His eyes were glossy and he had slurred speech. He had a bloody lip and small pieces of glass from the windshield stuck in his hair.
Peeking into the vehicle, officers observed an empty bottle of liquor on the ground of the passenger side and observed three empty shooters in a bag.
The male was transported by AMR to a nearby hospital where officers conducted a standard field sobriety test. During the test, the male told police that he was “unable” to perform any exam that required him to stand up. Upon being asked whether he could read the alphabet, the male stated he could not.
Officers read him his Miranda and DWI refusal warnings after he refused a chemical test. He received an appearance ticket returnable at Niagara Falls City Court. The vehicle was towed.
