A 28-year-old man has been charged with causing the death of his passenger in a high-speed crash in Buffalo's Riverside neighborhood according to the Erie County District Attorney’s Office. Alexander Kozak is alleged to have driven a modified 1992 Honda Civic at excessive speed while intoxicated when he collided with a tree on Arthur Street around 10pm on July 20th.
The passenger, identified as 30-year-old Sommer Lynn Toth, tragically lost her life at the scene of the accident. Kozak sustained injuries and was transported to ECMC for treatment. He faces charges of second-degree vehicular manslaughter and criminally negligent homicide. If found guilty of the most serious charge, he could face up to seven years in prison.
Prosecutors requested that Judge Andrew LoTiempo remand Kozak, but bail was set at $5,000 in cash or a $10,000 bond. A date for his next court appearance has not yet been established.
