Niagara Falls Police responded to the 7600 block of Wester Rivershore around midnight on February 1st after reports of a vehicle in a snowbank with the driver slumped over the steering wheel.
Upon arrival, officer spoke with the driver after he came to who was the sole occupant of the vehicle. Officers observed fresh damage to the left front quarter panel along with the left rear tire being separated from the wheel.
Speaking with the driver through the open driver window, offices smelled an odor of alcoholic beverage emanating from inside of the vehicle. The driver stated that he left La Galera and was attempting to return to the Niagara Falls Air Reserve Station. He admitted to drinking a half of bottle of wine which he claimed was 13.5% and also stated he did not strike anything.
The driver was asked if he knew the alphabet to which he stated he did. Officers asked him to speak the alphabet starting at letter H without singing it. For both attempts, he started with the letter A with the first attempt ending with him stating Q R F.
The driver refused a breathalyzer and was placed under arrest and handcuffed. After being read his Miranda rights, the driver stated he would not speak to police any further without a lawyer present. He was transported to police headquarters for booking and processing.
While still at the scene, officers located a half empty bottle of wine from the passenger front seat. There was also a half empty bottle of tequila on the passenger floorboard.
Once at police headquarters, the driver submitted to a chemical test and provided a sample of .15%. He was booked, processed and released with an appearance ticket.
