Niagara Falls Police were engaged in a two-man STOP-DWI enforcement detail around 9:40pm on December 14th when they observed a black sedan traveling westbound on Buffalo Avenue. Officers visually estimated its speed to be 45MPH and confirmed it to be 44MPH by radar. The posted speed limit was 30MPH.
Officers conducted a traffic stop on the vehicle, a 2015 Chevrolet Impala. Officers approached the driver-side of the vehicle and observed the side window to be blacked out and non-transparent.
The driver handed over his NYS ID and stated he had "paid $5,000 in fines so his license was "good." Officers then observed a clear plastic baggie containing suspected narcotics in plain view in the center console.
Officers advised the male driver to step out of the vehicle. The female passenger was directed to place her hands in her lap. Both individuals denied knowledge of the suspected narcotics.
Once the driver was secured in a patrol vehicle, officers detained the passenger. She was initially placed in the rear of a patrol vehicle due to the cold weather and her minimal clothing.
She was searched and additional narcotics were located. The specific location of said narcotics was not disclosed given her lack of clothes.
Additional items in the vehicle associated with narcotics were seized. The female was released from detention and drove the vehicle from the scene.
The male was transported to police headquarters for booking and processing where further narcotics were found on his person.
Officers subsequently found that the male’s driving privileges were revoked for failure to submit to a chemical test in 2021. He was processed and released with an appearance ticket.
